1. Introduction
Welcome to The Bodhi Tree. By accessing and using this website, you accept and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website. These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECT Act).
2. Products & Pricing
- All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
- We reserve the right to change prices at any time without prior notice. The price at the time of order placement will apply.
- Product images are for illustrative purposes; actual products may vary slightly.
- We take reasonable care to ensure product descriptions are accurate, but do not warrant that they are error-free.
3. Orders & Payment
- An order constitutes an offer to purchase. We reserve the right to accept or decline any order.
- Payment is processed securely via PayFast. We do not store your payment card details.
- Orders are confirmed once payment has been successfully processed and you receive an order confirmation.
- If a product is out of stock after your order has been placed, we will notify you and offer a refund or alternative.
4. Shipping & Delivery
- We deliver nationwide within South Africa at a flat rate of R150 per order.
- Estimated delivery times are 3–7 business days, depending on your location.
- Risk of loss and damage passes to you upon delivery. Please inspect your order upon receipt.
- We are not responsible for delays caused by courier services, public holidays, or circumstances beyond our control.
5. Returns & Refunds
In accordance with the Consumer Protection Act (CPA), you have the right to return goods within 6 months of delivery if they are defective, not as described, or not fit for purpose. To initiate a return, please contact us within 7 days of receiving your order. Items must be unused and in their original packaging. Refunds will be processed within 14 business days of receiving the returned item.
Please note: A "cooling-off" period of 5 business days applies to direct marketing transactions, during which you may cancel without reason in accordance with Section 16 of the CPA.
6. Intellectual Property
All content on this website — including text, images, logos, videos, and design elements — is the property of The Bodhi Tree or its licensors and is protected by South African intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by law, The Bodhi Tree shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or the purchase of our products. Our total liability shall not exceed the amount you paid for the specific product or order in question.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
